Employment Tribunal Claims

If an employee has a problem in the employment they may be able to make an employment tribunal claim. There are other ways of trying to resolve the problem before it gets to the tribunal claim. If you have tried all possible ways of resolving a workplace dispute for unlawful treatment and are unhappy with the outcome you can make a claim to the employment tribunal. You must notify ACAS of your plans to make a claim before any proceedings can start.

You will need to fill out an ET1 form to start your claim, this form is very important and you should get help and support to fill it out. You will need to write in full detail your complaint, be clear and concise and list it in date order. You must be certain that your claim is something that is against the law however you do not have to use legal jargon or legalese. There is usually a 3 month less, one-day time fame, from the day you were dismissed in which you can make a claim, however, there are some exceptions to the rule. A copy of your form will be sent to your employer for their input, comments and any defence they wish to bring to the claim. You should receive a copy of this about 4 weeks after you have submitted your form. It is very difficult to distinguish how long you will have to wait for a hearing date as it depends on a few different factors about the claim. If your case will only require 1 day in the hearing, then it will usually be around 4 - 6 months for a hearing, but these are only estimated timescales as it will depend on destination and other factors of the claim.
